Tris valandas užtrukęs prezidentės pokalbis su Generalinės prokuratūros vadovybe pasibaigė tuo, kad Algimantas Valantinas išsaugojo savo postą.
Nežinau, kokie argumentai iš generalinio prokuroro gynybinio arsenalo paveikė Dalią Grybauskaitę, bet aplaidus Kauno pedofilijos skandalo tyrimas, niekaip nebaigiamos tirti Vytauto Pociūno žūties, „Samanėlės“ bylos, pataikavimas VSD, kai prokurorai atlaidžiai žiūri į saugumiečių vykdomus privačių asmenų telefoninių pokalbių pasiklausymus, atrodo, netapo tuo pretekstu, kuris braškančią generalinio prokuroro kėdę priverstų subyrėti.
„Pedofilijos byla keliauja į teismą, kova su korupcija – akivaizdžiai matomi teigiami poslinkiai. Prezidentė konstatuoja, kad šiandien yra patenkinta ta veikla, kurią mato. Aišku, neatmetama galimybė, kad vėliau bus imamasi kitų raginimų, jei paaiškės, kad šie veiksmai nedavė rezultatų ar buvo neefektyvūs“, – prezidentės poziciją visuomenei perteikė jos atstovas spaudai Linas Balsys.
Tačiau nenorima pastebėti, kad tie „teigiami poslinkiai“ yra tiesiog „išlaužti“ iš prokurorų dėka didžiulio visuomenės, viešosios nuomonės spaudimo. Sunku prognozuoti, kokia būtų visuomenės reakcija, jei prokurorai paprasčiausiai būtų nutraukę Kauno pedofilijos bylą. Mintis, kad šie poslinkiai yra ne geravališkų pastangų rezultatas, o visuomenei nuraminti numestas kaulas, neatrodo be pagrindo. Andrius Ūsas atiduodamas teismui, tuo patenkinant teisingumo jausmą, bet visas ledkalnis lieka po tamsiu vandeniu.
Tokius nuogąstavimus tik stiprina aplinkybės, kad šioje byloje yra tik vienas įtariamasis – A. Ūsas. Daugiau nei keista, kad jokie įtarimai nepareikšti nukentėjusios mergaitės motinai L. Stankūnaitei. Kitaip tariant, dėdė Ūsas, kaip iš ano komikso, įsiviliojo mergaitę į automobilį ir nuskriaudė.
Kaip ir, atrodo, buvo neieškomas ir dar vienas galimas įtariamasis – vadinamasis Aidas. Gal tai prokuroro A. Kiuršino paviešinta „tyrimo taktika“: sprendimai nedaryti kratų įtariamo pedofilo A. Ūso namuose, nesiklausyti jo pokalbių, netirti jo bendrų su „dėde Jonu“ kelionių į egzotišką užsienį, neatlikti A. Ūso kūno apžiūros įtariant intymių vietų ypatybes, kurias minėjo mažoji pedofilų auka.
Ko gero tai pačiai taktikai vertėtų priskirti ir nukentėjusios mergaitės kompleksinės ekspertizės, kuri nepalanki A. Ūsui, neigimą, sklidusį iš generalinio prokuroro A. Valantino ir jo pavaduotojo Gintaro Jasaičio lūpų. Beje, parlamentinis tyrimas šią taktiką įvertino kaip aplaidžią, neoperatyvią, nekvalifikuotą ir konstatavo, kad dėl pareigūnų neveiklumo buvo neužkirstas kelias dviejų žmonių nužudymui. Prisiminkime, kad Seimui to pakako paskelbti, kad generalinis prokuroras nesugebėjo tinkamai organizuoti jo vadovaujamų institucijų darbo bei netinkamai vykdė teisės aktuose jam numatytas pareigas.
Prezidentė tokią nuomonę priskyrė „Seimo daliai“, tuo duodama suprasti, kad parlamentinės išvados neatspindi Seimo, kaip institucijos, požiūrio. Sutikime, kad taip galima niekiniu paversti ne vieną Seimo sprendimą… Žinoma, galima džiaugtis, kad prezidentės susitikime su Generalinės prokuratūros vadovybe buvo sutarta, kad reikia vykdyti reformas, kad prokuratūros darbo broką išgyvendintų rengiant „plačią, kardinalią, esminę reformą“.
Tikra tiesa, kurios nepaneigsi. Kelių galvų nuskraidinimas prokuratūros problemų neišspręs. Tačiau leiskite suabejoti, ar dabartinė Generalinės prokuratūros vadovybė yra pajėgi įvykdyti kokias nors reformas?
Kas slypi už žodžių „sisteminės problemos“? Juk tarp A. Valantino išvardytų pokyčių yra daug procedūrinių klausimų, kosmetiniai pakeitimai jos valdyme, bet jie yra veikiau kosmetinio pobūdžio nei pretenduojantys į esminę pertvarką, kuri užtikrintų visišką prokurorų savarankiškumą ir viešojo intereso gynimą.
Prokuratūros sisteminė bėda, kad ji pati yra virtusi sistemos dalimi. Turima omenyje antivalstybinė sistema, kurioje į vieną galios centrą yra susipynusi teisėsauga, VSD, žiniasklaidos ir verslo atstovai. Generalinis prokuroras yra tik šių jėgų statinys.
